New York Court Will Reconsider Allocation of Fault to Pedestrian
Hit in Unmarked Crosswalk
A pedestrian sued the vehicle driver who struck and injured him
while he was crossing a New York street within an nmarked crosswalk.
Although a jury awarded damages to the pedestrian, the appellate
court reversed the trial court's decision and remanded the case.

of a pedestrian who climbed the fence along an interstate and
was struck by a vehicle. Confirming the appellate court's reversal,
the Supreme Court of New Mexico remanded the case to the trial court.
